What is a Will?

A Will is a legal document that explains three main things:

Who gets your assets: Your house, vehicle, money, jewelry, or even your digital photos.

Who takes care of your dependents: If you have minor children or pets, this is where you name their guardians.

Who is in charge: You pick one person (your Personal Representative) to make sure your wishes are followed.

Importantly, a Will has specific formalities that must be followed so that it is valid.

Age, Capacity & Intent: the Testator is at least 18, of sound mind, and intends to create a Will.

Witnesses: Two (usually disinterested) people who are generally competent must see and witness the Will.

Signatures: The testator and witnesses must sign the Will.

A Will can be notarized so that it is Self-Proving. This means that it is ready for court without needing to prove the validity of it in court. You enter Probate with it assumed to be valid.

An Electronic Will (e-Will) has the same formalities (and legal benefits!) as a Paper Will. So you must be 18, have the capacity and intent to create a Will, have two witnesses view it, and have the testator’s and witnesses’ signatures. These requirements can be achieved through virtual communication and digital signature. Additionally, an e-Will also has the these extra requirements:

Date: Include the date of each signature

Identification: Include a copy of the Testator’s government identification card

After that, your e-Will is executed and valid - ready for court. But you can go the extra mile to protect the e-Will by making it Self Proving.

An e-Will is not Self Proving on its own. For the e-Will to be Self Proving:

Notarization: A Remote Online Notary notarizes the e-Will.

Qualified Custodian: Someone must act as a Qualified Custodian to store and protect the e-Will and the recordings of the signing.

A Qualified Custodian must not be related to the testator or receive anything under the e-Will and also do the following:

Safekeeping: Store an electronic record of the Wills in a system that protects the record from destruction, alteration, or unauthorized access while detecting any change to the electronic record.

Recordings: Create and Store the following virtual recordings:

A photo of the testator and witnesses during the signing

A photo of the documentation of the testator and the attesting witnesses and a description of the method of identification.

An audio and video recording of a the testator’s, witnesses’, and notary public’s signatures.

So, completing an e-Will with us ensures that it is executed with the correct formalities, notarized, and stored, allowing it to be Self Proving and ready for when it is needed. Completing an e-Will with us offers the same benefits of completing a physical Will combined with the ease of remote communication

After the Signing Session

After the Signing Session, you have two options for your e-Will:

We act as a Qualified Custodian, storing your e-Will in a safe, secure digital vault

Receive your own personalized digital vault where you have access to a copy of your e-Will.

Our management ensures that the e-Will is safe and secure online and is Self Proved - ready for the Probate Court without delay.

$50 a year. This yearly cost pays our storage and maintenance requirements under Arizona law, provides you access to a personalized digital vault for all your important file storage, and includes one meeting to touch base with us every year.

You Manage It

We transition the e-Will from Electronic to Paper. Store it at your home.

Unfortunately, if you use this option, the e-Will will not be Self Proving. And you risk losing the document.
